What is a Guardian ad litem?

A Guardian ad litem serves as the voice of a child during high conflict custody cases.

While many people have heard of a Guardian ad litem (GAL), we’ve found that most don’t exactly understand what their role is in a high conflict custody case.

High-conflict custody cases are defined as those where parents demonstrate a pattern of excessive litigation, high levels of anger and distrust, verbal and/or physical abuse, and/or difficulty co-parenting. Parents embroiled in litigation can easily and unintentionally lose sight of the heart of the matter – what is in their child’s best interest.  

Often called a “child’s advocate,” the GAL is appointed by the court to be the voice of the child(ren) whose parents are navigating a contentious custody matter. Although they are usually also attorneys, the GAL does not function as an attorney but rather as an investigator and witness for the children. A GAL helps the focus shift back to the best interests of the child. Once appointed, the GAL conducts an investigation, which includes speaking with the parents and/or legal guardians, building a relationship with the children in order to learn what their desire is, and interviewing a host of additional witnesses like therapists, doctors, family and friends. At the conclusion of their investigation, the GAL drafts a report to the court with their recommendations.
