Mediation

Mediation is a process that assists disputing parties in resolving conflict through the use of a trained mediator without going to court.  Mediation can also be a good option for parties choosing to enter a marriage and contemplating a premarital agreement.  At Gondring Law, we can serve your mediation needs as the neutral mediator or as your legal counsel.

 

Neutral Mediator

Spouses who have decided to dissolve their marriage can hire a neutral mediator and participate in mediation prior to anyone filing a lawsuit.  Mediation generally takes less time, is less expensive and provides more privacy than litigation. 

An attorney serving as a neutral mediator to parties not represented by their own attorneys cannot give either party legal advice during the mediation and cannot prepare the settlement documents should the parties come to a resolution.  This type of mediation works best when spouses are not seeking legal advice and are focused on creating a solution that works well for their family.  Individuals who are interested in a solutions-focused process and would also like to receive legal advice should consider the Collaborative Process.

Legal Counsel in Mediation

In North Carolina, parties are required to participate in mediation prior to litigating child custody and property distribution.  While they are not required to do so for claims related to spousal support or child support, parties often choose to participate in a global mediation in an attempt to resolve all issues contemporaneously. Gondring Law can serve these mediation needs.
